Terms of Service

TrustMark is a verified link page anchored to a real human. We confirm you're a unique person and issue a portable, cryptographically signed credential you can present anywhere on the web — at trustmark.app/yourhandle, embedded on your own site, or shared as a link.

We offer two tiers today, with a third coming soon:

• Tier 1 — Presence (free):a selfie plus a live liveness challenge confirms you're a unique human. No payment, no ID required.
• Tier 2 — Identity ($6/month): adds government-ID verification, manually reviewed, with cryptographically signed claims about your age range and jurisdiction.
• Tier 3 — Witness (coming soon): a licensed notary co-signs your credential for legal-grade attestation.

Your credential proves you're a verified real person — it does not reveal your name, address, exact date of birth, or any other personal details to anyone who views or queries it.

When you use TrustMark, you agree that:

• You are at least 18 years old
• The identity documents you submit belong to you
• You will not attempt to verify using someone else's identity
• You will not attempt to create multiple credentials for yourself
• You will not share, sell, or transfer your credential to anyone else
• The information you provide is accurate and current

Attempting to circumvent these requirements may result in credential revocation and permanent account termination.

A TrustMark credential is issued upon successful verification.

• Tier 1 credentials remain valid as long as your account exists. There is no recurring charge and no expiry.
• Tier 2credentials remain valid as long as your $6/month subscription is active. If your subscription ends — by your cancellation, by our cancellation, or because we couldn't collect payment after Stripe's retry attempts — your credential is downgraded to Tier 1, not deleted (see “Subscription cancellation” below).
• You may share your credential URL with any platform or individual.
• Platforms may verify the credential by visiting the public URL or via our API.
• You can delete your credential at any time from your account page.
• We reserve the right to revoke credentials that violate these terms.

TrustMark is currently available to residents of the United States (except Illinois), Canada, United Kingdom, and the European Union. Illinois residents are temporarily excluded pending a BIPA-compliant consent flow.

We may suspend or terminate service for any jurisdiction where the law or regulatory environment makes continued service impractical.

TrustMark is under active development. We may update features, pricing, and functionality. Material changes will be communicated via email to active users.

We do not guarantee uninterrupted service. Verification may be temporarily unavailable during maintenance or in the event of third-party outages (Stripe, Google Cloud, Resend).

Tier 1 is free. No payment method is required and no charge will ever be made for a Tier 1 credential.

Tier 2is $6 per month, billed via Stripe on a recurring monthly subscription. The first month is charged at checkout, and you're billed every month thereafter on the same calendar day. You can manage your payment method, view invoices, or cancel at any time through the Stripe Billing Portal, which is linked from your account page.

Refund on rejection: if our manual review cannot verify your Tier 2 submission, your most recent invoice is refunded in full and your subscription is canceled automatically. Tier 1 has no payment, so no refund applies; if our sybil check flags your selfie, your case is queued for human review rather than auto-rejected.

We may adjust pricing in the future with at least 30 days' advance notice by email. Changes never apply retroactively — your current rate is locked in for as long as your subscription stays active without interruption.

Cancelling your Tier 2 subscription does not delete your account, your credential, or your handle. When the subscription ends, your credential is downgraded to Tier 1: your handle, custom theme, profile links, and click counts all stay exactly as they were. Your signed credential is re-signed with Tier 1 claims (the age-range and jurisdiction claims are removed) and your public link page stays live.

You can re-upgrade to Tier 2 at any time from your account page by re-running the ID-capture step.

TrustMark is provided "as is" without warranty of any kind. While we take reasonable measures to ensure verification accuracy, we do not guarantee that:

• Every verification decision is correct
• The service will be available at all times
• Third-party platforms will honor or accept TrustMark credentials

TrustMark is not a substitute for regulated identity verification in contexts where specific legal standards apply (e.g., financial KYC, medical records access).

To the maximum extent permitted by law, TrustMark and its affiliates are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim (or $100, whichever is greater).

You will not use TrustMark to:

• Harass, defraud, or deceive others
• Present a TrustMark credential in a misleading context
• Interfere with or disrupt the service
• Attempt to reverse-engineer or extract data from our verification systems
• Violate any applicable law or regulation

You may delete your credential and account at any time from the account page. We may terminate accounts that violate these terms or engage in fraudulent activity.

Upon termination, your credential is revoked, your handle becomes available to other users, your face embedding is removed from our biometric index, and any active Tier 2 subscription is canceled. We don't prorate or refund mid-month subscription charges on voluntary deletion.

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, or via binding arbitration where applicable.
